Terms of Service

Welcome to PixZoo (https://pixzoo.ai, hereinafter referred to as "the Platform" or "we"). These Terms of Service ("Terms") form a binding agreement between you and the Platform. Please read and fully understand these Terms before registering, signing in, accessing, purchasing, or using any Platform service. By checking the consent box, registering, signing in, accessing, or actually using the Platform, you are deemed to have read, understood, and accepted these Terms.
1. Parties and Nature of the Service
- The Platform provides AI-powered image generation, image editing, video generation, prompt processing, style transfer, asset processing, and related technical support services.
- The Platform acts as a neutral technical tool provider. It only provides automated generation, editing, and processing capabilities based on the text, images, parameters, or instructions you submit. Except as otherwise required by law, the Platform does not participate in your specific creative purposes, distribution purposes, commercial uses, or publishing activities.
- You are solely responsible for the content you input, upload, generate, download, publish, or distribute, and for all consequences of its actual use.
- The Platform may, from time to time, adjust service features, model capabilities, available quotas, usage rules, moderation standards, pricing, or restriction policies in accordance with applicable laws, regulatory requirements, operational needs, and risk-control requirements.
2. Eligibility
- You must have the legal capacity appropriate to your actions under applicable law.
- If you are a minor under the law of your jurisdiction, you may use the Platform only with the consent and under the guidance of a parent or legal guardian. The Platform may apply feature limits, time limits, content limits, or identity verification to accounts belonging to (or suspected to belong to) minors.
- You undertake not to access or use the Platform in any manner prohibited by law, including but not limited to borrowing, stealing, or impersonating another person's identity to register or use an account.
3. Account Registration and Security
- When registering, signing in, or using the Platform, you must provide true, lawful, accurate, and complete information and keep it up to date.
- You are responsible for safeguarding your account, password, verification codes, API keys, access tokens, and other credentials. Losses and liabilities caused by your improper safekeeping, or by voluntarily disclosing, sharing, transferring, renting, or lending your account, are borne by you.
- The Platform may require identity verification, phone or email verification, business qualification verification, or other necessary checks where required by law, regulation, risk control, complaint handling, or security incident response.
- If an account shows signs of abnormal sign-ins, bulk registration, scripted calls, API abuse, credential stuffing, traffic manipulation, content laundering, risk-control evasion, arbitrage, or reselling of services, the Platform may immediately restrict sign-in, freeze quotas, suspend service, or ban the account.
4. Scope of Service and Usage Boundaries
- Services provided by the Platform include, but are not limited to:
- AI image generation;
- AI video generation;
- image editing, inpainting, outpainting, and stylization;
- prompt assistance and processing;
- related APIs, orders, memberships, credits, subscriptions, or other value-added services.
- The Platform provides technical tools only and does not warrant that generated content will be true, accurate, lawful, defect-free, bias-free, non-infringing, fit for a particular purpose, or consistent with your subjective expectations.
- AI-generated content may contain errors, distortions, biases, repetition, similarity to other works, recognition errors, unstable styles, abnormal details, or deviations from your instructions. You must review such content yourself and bear the risks of using it.
- You must not use content generated on the Platform in any scenario that requires a high degree of authenticity, accuracy, reliability, or statutory professional qualification, including but not limited to judicial proceedings, law enforcement, government affairs, notarization, fabrication of evidence, identity authentication, medical diagnosis, credit decisions, investment advice, emergency response, or manipulation of public opinion.
5. Your Input, Uploads, and Generated Content
- The text you enter, the images you upload, reference materials, parameter settings, generation results, editing results, and derivative results are collectively referred to as "User Content."
- You warrant that you hold the lawful rights to the User Content you submit, or have obtained all necessary authorizations, and that it does not infringe any third party's copyright, trademark, patent, portrait rights, reputation rights, privacy, personal data rights, trade secrets, or other lawful rights and interests.
- You authorize the Platform to store, process, analyze, invoke, and transmit your User Content to the extent necessary for providing the service, content-safety moderation, troubleshooting, complaint handling, risk identification, log retention, evidence preservation, and compliance verification.
- Without your separate express authorization, the Platform will not publicly display your non-public User Content, except as otherwise provided by law, lawfully required by competent authorities, or necessary to protect the lawful rights of the Platform or others.
- Before publishing, distributing, or commercially using content generated on the Platform, you must complete your own authenticity checks, rights clearance, compliance review, and any required labeling.
6. Prohibited Conduct and Prohibited Content
You must not use the Platform to create, copy, upload, download, publish, distribute, store, or otherwise process any content that is illegal, harmful, or high-risk, including but not limited to:
6.1 Content endangering national or public security
- content endangering national security, leaking state secrets, or inciting subversion, separatism, or undermining national unity;
- fabricating or spreading false political information, or forging or impersonating the name or image of government bodies, state organs, the military, police, courts, public institutions, or news organizations;
- creating or distributing false images of political figures, government bodies, official documents and certificates, official news scenes, law-enforcement scenes, or major disasters that could confuse or mislead the public.
6.2 Sexual content and risks to minors
- obscene or pornographic content, sexual solicitation, voyeurism, or content depicting or implying non-consensual sexual acts;
- any content involving minors that is nude, sexually suggestive, sexualized, or otherwise harmful to minors' physical or mental health.
6.3 Gambling and illegal transactions
- gambling, betting, casinos, illegal lotteries, gambling techniques, cheating tools, or gambling traffic funneling;
- money laundering, cash-out schemes, fraud, pyramid schemes, or illegal fundraising;
- drugs, firearms, explosives, controlled instruments, forged documents or seals, or other illegal goods or services.
6.4 Violence, terrorism, extremism, and hate
- terrorism, extremism, attack tutorials, or assault guides;
- gore, cruelty, abuse, or encouragement of self-harm or suicide;
- discrimination, insult, or incitement of hatred based on ethnicity, race, religion, region, gender, or similar grounds.
6.5 False information, fraud, and deepfakes
- using generated content to impersonate real persons or organizations, forge news, fabricate events, or deceive or defraud others;
- creating deceptive deepfake images or videos of real persons without lawful authorization;
- forging certificates, official documents, seals, bills, contracts, qualifications, or test reports.
6.6 Infringement of third-party rights
- infringing others' copyright, trademark, patent, portrait rights, privacy, personal data rights, or trade secrets;
- uploading images of others without authorization for face swap, undressing, defamation, harassment, or intimidation.
6.7 Data and system security
- uploading, entering, or processing unlawfully obtained personal information, sensitive personal information, trade secrets, or internal materials;
- using the Platform for network attacks, vulnerability scanning, malicious collection, data scraping, reverse engineering, model jailbreaking, prompt-injection attacks, risk-control evasion, or bulk abuse;
- interfering with, damaging, or overloading the Platform's servers, APIs, databases, risk-control systems, or other infrastructure.
6.8 Other illegal or non-compliant content
- content prohibited by applicable laws, regulations, regulatory policies, industry norms, these Terms, or Platform rules;
- other content that the Platform reasonably determines may create legal, public-opinion, regulatory, public-safety, or reputational risk.
7. Moderation, Enforcement, and Reporting
- To fulfill legal obligations, maintain Platform order, and control risk, the Platform may conduct automated moderation, manual review, risk identification, log analysis, and security interception of User Content and usage behavior.
- For suspected illegal, infringing, false or misleading content, risk-control evasion, malicious complaints, or service abuse, the Platform may unilaterally take one or more of the following measures:
- refusing to generate;
- deleting, blocking, replacing, or restricting the display of relevant content;
- restricting features, throttling, suspending service, freezing quotas, or banning the account;
- canceling orders, terminating membership, or refusing all or part of a refund;
- requiring supplementary explanations, proof of authorization, proof of rights, or proof of identity;
- preserving relevant records, logs, device information, transaction information, and IP information, and reporting to or cooperating with competent authorities as required by law.
- If your conduct is suspected of constituting a crime, serious infringement, or a serious threat to Platform security, the Platform reserves the right to pursue your legal liability, including claims for breach of contract and damages, and to cooperate with the authorities.
- The Platform's failure to immediately discover or act on a violation, or its temporary tolerance of one, does not constitute a waiver of any rights.
8. Labeling Obligations for AI-Generated Content
- You understand and agree that the Platform may, in accordance with laws, technical standards, or regulatory requirements, add explicit labels, implicit labels, watermarks, metadata markers, anti-counterfeiting traces, or other identifiable marks to generated content.
- You must not delete, obscure, tamper with, or circumvent such marks, nor use technical means to evade the Platform's marking, identification, tracking, or risk-control measures.
- When publishing, distributing, or commercially using content generated on the Platform, you must fulfill any applicable AI-generated-content labeling, disclosure, and non-misleading obligations required by law or by the specific context.
9. Intellectual Property and Complaints
- All rights in the Platform and its software, pages, programs, interface designs, trademarks, logos, copy, technical architecture, and databases belong to the Platform or its lawful rights holders.
- Without the Platform's written permission, you must not copy, sell, rent, sublicense, mirror, reverse engineer, scrape, bulk export, or otherwise unlawfully exploit the Platform.
- If a third party claims that your User Content infringes its lawful rights, the Platform may, based on the complaint materials, first take measures such as deletion, blocking, link removal, access restriction, or account freezing.
- You agree to bear all intellectual-property and personality-rights disputes arising from your User Content and to compensate the Platform in full for any resulting losses.
10. Personal Information and Data Protection
- The Platform values user personal information and data security and will process such information in accordance with applicable laws and the Privacy Policy.
- The Platform collects and processes personal information only to the extent necessary to deliver features, ensure security, handle complaints, and fulfill legal obligations.
- You must not upload, enter, or process any unlawfully obtained personal information, sensitive personal information, biometric information, minors' personal information, or other data that may not lawfully be processed.
- If content you submit contains a third party's personal information, you warrant that you have obtained lawful authorization or have another lawful basis for processing it.
- You bear all legal liability arising from your unlawful processing of personal information or data, and must fully compensate the Platform for any resulting losses.
11. Payment, Orders, and Refunds
- Some Platform services are paid services. Specific prices, membership benefits, subscription cycles, quota rules, and usage terms are as displayed on the relevant pages.
- You may request a refund within three (3) months of the date of purchase. Refund requests made more than three months after purchase are not supported.
- If, before the refund request, you have already activated, invoked, or consumed part of the service (including but not limited to membership benefits, generation counts, compute quotas, subscription duration, or API calls), the Platform may deduct a reasonable amount corresponding to actual usage, consumed resources, and activated benefits, and refund the remainder, unless otherwise required by law.
- If you suffer a loss for reasons not attributable to you — such as a Platform system failure, duplicate charge, or a service that was never actually activated — the Platform will process a refund or compensation under the applicable rules.
- You must not harm the lawful interests of the Platform or third parties through malicious refunds, false complaints, chargebacks, stolen cards, or cash-out schemes.
12. Disclaimer
- The Platform provides its services on an "as is" and "as available" basis, and makes no express or implied warranty that the services will be uninterrupted, fault-free, absolutely secure, fully accurate, fully lawful, non-infringing, or fully compliant with your needs.
- The Platform is not liable for service interruptions, content deviations, data delays, abnormal results, or feature adjustments caused by technical defects, network fluctuations, algorithmic bias, third-party service failures, hacker attacks, system upgrades, regulatory requirements, or force majeure, except as otherwise required by law.
- You bear all risks and responsibilities for editing, publishing, distributing, trading, advertising, brand use, evidentiary submission, or external commitments made on the basis of content generated on the Platform.
- The Platform is not liable for disputes between users, or between users and third parties, over content use, authorization, infringement complaints, reputation, or transactions.
13. Liability for Breach
- If you violate these Terms, Platform rules, or applicable law, the Platform may take measures commensurate with the severity of the breach and require you to compensate the Platform, its affiliates, partners, or third parties for all resulting losses.
- Such losses include, but are not limited to, administrative fines, regulatory penalties, civil damages, attorney fees, notarization fees, litigation and arbitration fees, travel expenses, appraisal fees, reasonable enforcement costs, goodwill losses, and system remediation costs.
- If your conduct is suspected of constituting a crime, the Platform will report it to the competent authorities and cooperate with the investigation.
14. Changes to These Terms and Notices
- The Platform may update these Terms in response to changes in law, regulatory requirements, business development, product adjustments, or risk-control needs.
- Updated Terms will be communicated via website announcements, in-product notices, pop-ups, email, or other reasonable means.
- If you continue to use the Platform after the updated Terms take effect, you are deemed to accept them; if you do not agree, you must stop using the Platform immediately.
15. Governing Law and Dispute Resolution
- The formation, effectiveness, interpretation, performance, and dispute resolution of these Terms are governed by the laws of the jurisdiction where the Platform operator is registered, without regard to conflict-of-law rules.
- Any dispute arising from or relating to these Terms shall first be resolved through friendly negotiation; failing that, either party may bring the dispute before a court of competent jurisdiction at the place where the Platform operator is registered.
